ORDER
This Contempt Petition has been filed to punish the respondents for committing contempt of the order passed by this Court on 23.01.2025 in Crl.O.P.No.23875 of 2024.
2. The grievance of the petitioner is that she had filed a petition before this Court in Crl.O.P.No.23875 of 2024 seeking direction to the respondents to file final report in Crime No.82 of 2013 and this Court, vide order dated 23.01.2025 closed the petition recording the submissions made by the learned Additional Public Prosecutor that the final report has been filed through e-filing before the learned Judicial Magistrate, Kancheepuram. Subsequently, the petitioner made a copy application seeking the copy of the final report before the Judicial Magistrate, Kancheepuram, but the same was returned with an endorsement that 'no such final report is filed'.
3. The learned Government Advocate (Crl. Side) appearing for the respondents submitted that the charge sheet was filed before the Judicial Magistrate No.1, Tambaram on 03.01.2024 through e-filing and due to non availability of some particulars, C.C. number was not assigned. Now, due to jurisdictional reason, the case has been transferred to Judicial Magistrate No.I, Kancheepuram. The respondents have filed an affidavit to that effect and the relevant paragraph is read as follows: "25. I respectfully submit that, after continuous and coordinated efforts along with the police, the court staff restored the records pertaining to the above-said case. Along with this case, 14 other cases were transferred by getting for approval a letter was sent to the Hon'ble Chief Judicial
Magistrate, Chengalpattu, by Judicial Magistrate-I, Tambaram, vide reference No.D.No.17/2026, dated 07/01/2026, and the same was approved and order Dis.No.89/A/2026, dated 19.01.2026. Based on that order, all the records along with the above case were transferred to Judicial Magistrate I, Kancheepuram vide D.No.60/2026, Dated 20.01.2026 and it is pending for assigning C.C. number."
3. Recording the submissions of the learned Additional Public Prosecutor, this Contempt Petition is closed.
4. However, considering the age of the defacto complainant/contempt petitioner, the learned Judicial Magistrate No.1, Kancheepuram, is directed to take the charge sheet on file, if the papers are otherwise in order and proceed further in accordance with law.10 23.01.2026 ksa-2
