The petitioner, who was arrested and remanded to judicial custody on 06.08.2022 for the offences punishable under Sections 8(c), 20(b)(ii)(B) of NDPS Act, 1985, in Crime No.298 of 2022 on the file of respondent police, seeks bail.

2. The case of the prosecution is that on 06.08.2022, when the respondent on regular patrol, the petitioner and other accused were found to be in possession of 1.200 Kgs of Ganja. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that A2 and A3 in this case were arrested and released on bail and that the petitioner is ready to abide by any stringent conditions imposed by this Court. Therefore, he prays for grant of bail to the petitioner.

Per contra, the learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner and other accused were found to be in possession of 1.200 Kgs of Ganja and the contraband has been recovered from them. Further, there is one previous case pending against the petitioner in similar nature. Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking into consideration the facts of the case and the submissions made by the learned counsel, and also taking note of the fact that there is one previous case pending against him in similar nature, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed for the present.
