ORDER

This writ petition has been filed seeking to direct the respondents to pay the Death cum Retirement Gratuity, pay pension from the date of retirement viz., 01.01.2023, pay commuted value of pension along with interest at the rate of 12% per annum in terms of G.O.Ms.No.122, Finance (Pension) Department dated 20.02.1995.

2. Now, it is stated by the learned counsel for the petitioner submitted that after filing of the writ petition, the amount has been paid on 28.08.2023 with a delay. There was no reason assigned for such a delay. Such view of the matter, as per G.O.Ms.N.122, Finance (Pension) Department dated 20.02.1995, he is entitled to interest for the delayed payment. Hence, this writ petition.

3. Heard both sides and perused the materials placed on record. Considering the fact that the amount has been withheld. The respondent shall pay the interest at the rate of 7% p.a., for the period 01.01.2023 to 28.08.2023 and the said amount shall be disbursed within a period two months from the date of receipt of a copy of this Order.
