This Criminal Original Petition has been filed by the petitioner/A3, who was arrested and remanded to judicial custody on 26.06.2024, seeking bail in Crime No.264 of 2023 for the alleged offences punishable under Sections 406, 420 r/w Section 120-B, 34 of IPC.
2. Learned counsel appearing for the petitioner submitted that this is the second petition and the earlier petition was dismissed by this Court in Crl.OP.No.17661 of 2024 dated 25.07.2024. He further submitted that the petitioner is working as a Machine Operator in Heavy Vehicle Factory, Avadi and he is no way connected with the alleged offence. He also submitted that the petitioner himself is a victim in this case, who has deposited a sum of Rs.3 lakhs in A1 company and he had also lodged a complaint, which is still pending. He further submitted that the petitioner has been in custody from 26.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court, hence, he sought for bail.

Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection stating that, the accused had induced the de-facto complainant and others with fancy schemes and by giving false promise and assurance that they will get good returns, made them to invest in their company named Capital Gain Financial Company and cheated them to the tune of Rs.1,12,00,000/-. 4. He also submitted that the case is under investigation and no recovery was made from the accused, therefore, if the petitioner is released on bail at this stage, there is a possibility of him absconding and not available for further investigation.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the gravity and nature of the offence committed by the accused and also considering the facts that the case is under investigation and no amount has been recovered so far, and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
