By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the 3rd respondent to issue appointment order to the petitioner in the post of Village Assistant who was selected in the written and oral examination which was held on 04.12.2022 and 07.01.2023 respectively.

3. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that a notification was issued by the 1st respondent on 09.10.2022 and in pursuance of the same, the petitioner has applied for the post of Village Assistant and she also participated in the written examination. It is the further submission of the petitioner that inspite of possessing all required qualifications, she has 2/6

not been considered by the respondents and in this connection, she has sent a representation on 24.04.2025 to the 3rd respondent seeking an appointment to the post of Village Assistant.

At this juncture, the learned Additional Government Pleader appearing for the respondents would strongly object the contention of the petitioner and would submit that though the petitioner had participated in the examination for the post of Village Assistant, she did not possess required skill test of riding cycle. Hence, she was not considered for appointment. It is the further submission of the learned Additional Government Pleader that the selection process has already over and an another person has been appointed in the post of Village Assistant. Therefore, there is no question of appointing the petitioner in the Village Assistant post. Hence, prayed to dismiss the writ petition.

6. Though learned Additional Government Pleader would submit that the selection process has already been over, the fact remains that the petitioner's representation dated 24.04.2025 is pending with the 3rd respondent. Therefore, there is a duty cast upon the 3rd respondent to pass 3/6

order upon the petitioner's representation on it's own merits.

In view of the above position, this Court deems it appropriate to direct the 3rd respondent to consider the petitioner's representation dated 24.04.2025 and pass orders according to it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.

8. With the above direction, the Writ Petition is disposed of. No costs. 22.07.2025 Index : Yes/No Speaking order /Non Speaking Order dm 4/6
