Respondents Prayer : Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records on the file of the Registrar of the District, (Housing), Salem Region, Salem, the 1st respondent herein in his Proc.No.E.P.No.298/09.10 Suit No.826/02.03 dated 21.06.2010 in bringing the property for auction is concerned and quash the same is arbitrary, unreasonable, being violative of Tamilnadu Co-operative Societies Act and consequently direct the respondents herein to restrain from bringing the property from auction sale and to furnish the correct details of payment dues and permit the petitioner to repay the amount in monthly instalments and pass further orders.

The learned counsel for the petitioner submitted that the entire amount has been settled and hence the Writ Petition has became infructuous. He has also made an endorsement to that effect.

2. In view of the submission and the endorsement, made by the learned counsel for the petitioner, this Writ petition is dismissed as infructuous. No Costs. Consequently connected Miscellaneous petition is closed.
