A.No.4640 of 2021 in C.S.No.879 of 2005 A.No.4640 of 2021 in C.S.No.879 of 2005 N.SESHASAYEE, J., The applicant/plaintiff has filed this application to remove the name of the 11th defendant from the array of the respondents/defendants.

The learned counsel for the applicant informs the Court that the 11th defendant has been impleaded as the legal heir of the deceased 6th defendant Vide order of this Court dated 12.03.2020 in A.No.394 of 2020, and now it is brought to the notice of the Court that the 11th defendant is not the legal heir of the 6th defendant and hence her name in the party array may be removed.

3. Heard the learned counsel. This application is allowed, and the name of the 11th defendant on record may be removed. Consequently, the 12th and 13th defendant already on record may be re-ranked as 11th and 12th defendant. The legal heirs of the deceased 6th defendant are impleaded as defendants 13 to 16.
