The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(4) of the Tamil Nadu Schedule Commodities (RDCS) Order 1982, Section 7(1)(a)(ii) of Essential Commodities Act 1955 in Crime No,.138 of 2023, seek anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found to be in illegal transportation of 1150 Kgs of PDS rice worth about Rs.37,950/-. Hence, the complaint.

3. The learned counsel for the petitioner would submit that this is the 3rd application for anticipatory bail. He would submit that the earlier applications were dismissed on the ground that the petitioner has got 7 previous cases of similar nature. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that this is the case where, the petitioner along with the other accused were found in possession of 1150 Kgs of PDS rice worth about Rs.37,950/-. He would submit that this Court, taking into consideration that the petitioner is a habitual offender against whom seven previous cases of similar nature are pending, dismissed the earlier application and that there is no change of circumstances after the earlier dismissal of the anticipatory bail.

5. Considering the submissions made by both sides, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
