M.Seenivasan v. The Assistant Director

W.P.No.24484 of 2019 R.Subbiah,J and C.Saravanan,J (The Order of the Court was made by R.Subbiah, J) This Writ Petition is listed today under the caption "for being mentioned" at the instance of the learned counsel for the petitioner.

2. At the time of releasing the vehicle Bolero Maxi Truck bearing Registration No.TN-48-AH-0093, in paragraph 6 and 6(i), this Court, by order dated 22.08.2019, had observed as follows:

"6. Accordingly, the first and second respondents are directed to release the vehicle in question to the petitioner within a period of 7 days from the date of compliance of the below mentioned condition Nos.(i) to (iii):

(i) Petitioner shall deposit a sum of Rs.50,000/- (Rupees fifty thousand only) before the jurisdictional Tahsildar concerned as non-refundable deposit. After receipt of the above said amount, the same will have to be deposited by the jurisdictional Tahsildar concerned, to the credit of the District Mines and Minerals Foundation Trust as non-refundable deposit."

3. Taking into consideration the fact that the vehicle in question is only of the model like mini truck lorry, now, this Court modifies the said amount of Rs.50,000/- as quoted above in paragraph 6(i) quoted above, to Rs.25,000/- of the said order dated 22.08.2019. Resultantly, paragraph 6 and 6(i) of the said order dated 22.08.2019 shall stand substituted as follows: "6. Accordingly, the respondents are directed to release the vehicle TN-48-AH-0093 Bolero Maxi Truck to the petitioner within a period of 7 days from the date of compliance of the below mentioned condition No.(i):

(i) The petitioner shall deposit a sum of Rs.25,000/- (Rupees twenty five thousand only) before the jurisdictional Tahsildar concerned as nonrefundable deposit. After receipt of the above said amount, the same will have to be deposited by the jurisdictional Tahsildar concerned, to the credit of the District Mines and Minerals Foundation Trust as nonrefundable deposit."

4. It is made clear that the time limit of seven days as mentioned above now in paragraph 6(i), shall run from the date the petitioner deposits the said amount of Rs.25,000/- (Rupees twenty five thousand only).

5. In other respects, the earlier order dated 22.08.2019 shall remain unaltered.
