O R D E R

This criminal original petition has been filed to modify the condition dated 08.11.2016 in Crl.MP.No.2598 of 2016 imposed by the Principal District and Sessions Judge, Coimbatore, while granting bail to the petitioner in relation to the case registered as crime No.59 of 2016 on the file of the respondent.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the State.

On the complaint lodged by one Sathya, the respondent police registered a case in Crime No.59 of 2016 for an offence under Section 498-A IPC against Thamil Venthan (A1), his parents Kasthuri and Karuppusamy, his sister Vennila, and Balakumar, husband of Vennila. It is seen that the petitioner's parents Kasthuri and Karuppusamy, Vennila, (sister) and Balakumar, (sister's husband) have filed an application for anticipatory bail in Crl.OP.Nos.24233 of 2016

and 24239 of 2016 before this Court. This Court, by order dated 15.11.2016, has directed Vennila and Balakumar, Kasthuri and Karuppusamy, to appear before the Mediation and Conciliation Centre, High Court, Madras.

4. While so, Thamil Venthan (A1) filed an application for anticipatory bail in Crl.MP.No.2598 of 2016 before the Principal District and Sessions Judge, Coimbatore. The Principal District & Sessions Judge, Coimbatore has granted anticipatory bail on 08.11.2016 and has further directed the parties to appear before the District Mediation Centre, Coimbatore for bringing an amicable settlement between the parties.

5. Under such circumstances, Thamil Venthan (A1) has filed the present petition for modification of the aforesaid condition on the ground that he is ready and willing to appear before the Mediation and Conciliation Centre, High Court, Madras.

6. In the considered opinion of this Court, Thamil Venthan (A1) has been granted interim anticipatory bail and only thereafter, the matter has been referred to the local Mediation Centre, where it is easier for the de-facto complainant to appear and bringing about mutual settlement.

7. Under such circumstance, it would not be advisable to direct Thamil Venthan (A1) and Sathya to come all the way to Chennai to appear before the Mediation and Conciliation Centre, High Court, Madras. It is open to Vennila, Balakumar, Kasthuri and Karuppusamy, to file appropriate modification petitions in Crl.OP.Nos.24233 of 2016 and 24239 of 2016, contending that they are also appearing before the Mediation Centre, Coimbatore. The petitioner may also approach the District & Sessions Court, Coimbatore for extension of the interim order.
