An interim order of stay was passed by this Court on 13.10.2022 on condition that the petitioner shall deposit a sum of Rs.5 lakh to the credit of OS No.71 of 2015 on the file of the Additional District Court, Namakkal, within a period of six weeks.

2. The learned counsel appearing on behalf of the appellant made a submission that the conditional order passed by this Court has not been complied with by the appellant.

3. Thus the order of interim stay granted by this Court on 13.10.2022 stands vacated and consequently, CMP No.16022 of 2022 stands dismissed.

4. Post the Appeal Suit for hearing after two weeks. 10-02-2023 Svn S.M.SUBRAMANIAM, J.
