ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for writ of Mandamus, to direct 2/6

the third and fifth respondents to refer the application dated 08.03.2021 of the petitioner company seeking higher compensation to the District Court, Kancheepuram for fixation of fair award amount under Section 20 of Tamil Nadu Highways Act, 2001 within a time frame to be fixed by this Court.

3. The case of the petitioner is that they submitted an application dated 08.03.2021 before the third and fifth respondents to refer the matter to the District Court, Kancheepuram for fixation of fair award amount. However, the said application has not been considered so far. Aggrieved by the same, the petitioner has filed the present writ petition.

4. At the outset, it was submitted by the learned Additional Government Pleader appearing on behalf of the respondents that the above application would be considered and appropriate measures would be initiated, in accordance with law, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

5. In view thereof, the respondents 3 and 5 shall consider the application dated 08.03.2021 of the petitioner and initiate appropriate measure within a period 3/6

of four (4) weeks from the date of uploading of web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioner and all other interested parties are left open.

6. Accordingly, the writ petition stands disposed of. There will be no order as to costs.
