This writ petition has been filed for issue of writ of mandamus directing the 1st respondent to consider the representations made by the petitioner on 12.07.2023 and 03.07.2024, wherein, the petitioner is seeking for notional promotion to the post of Municipal Commissioner Grade-II w.e.f. 06.03.2020 and for the consequential monetary reliefs.
2.Heard Mr.K.C.Karl Marx, learned counsel appearing on behalf of the petitioner and Mr.C.Selvaraj, learned Additional Government Pleader appearing on behalf of the respondents.
3.The case of the petitioner is that on 12.12.2021, the petitioner was given promotion as Municipal Commissioner Grade-II post on the pre-revised seniority. The 2nd respondent passed an order on 24.06.2023 granting notional 2/4
promotion to the petitioner considering his initial date of appointment as 22.01.1990. However, the further promotion to the post of Municipal Commissioner Grade-II was not given notionally from 06.03.2020. In view of the same, the petitioner gave a representation dated 12.07.2023 to the 1st respondent seeking promotion as Municipal Commissioner Grade-II notionally with all other monetary benefits w.e.f. 06.03.2020. Since the representation did not evoke any response, the present writ petition has been filed before this Court seeking for appropriate directions.
4.Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in this writ petition, there shall be a direction to the 1st respondent to deal with the representation made by the petitioner on 03.07.2024 on its own merits and in accordance with law and take a decision, within a period of eight weeks from the date of receipt of copy of this order and convey the same to the petitioner. 5.The petitioner is directed to make a fresh representation to the 1st respondent along with all the relevant documents and also a copy of this order. 3/4
