This petition has been filed to condone the delay of 343 days in filing the above second appeal in SA.SR.No.47892 of 2021.

2. The learned counsel appearing for the respondent would submit that he had no instruction from the respondent.

3. Considering the reasons stated in the affidavit filed in support of the condone delay petition, this Court is inclined to allow the petition on condition that the petitioner shall pay a sum of Rs.5,000/ as cost to the respondent on or before 20.03.2023, failing which, this petition shall stand automatically dismissed.

4. Registry is directed to return all the original documents to the counsel on record.
