When the matter was taken up for hearing on 22.09.2022, the learned Additional Public Prosecutor submitted that the State has preferred an appeal with the delay of 102 days for enhancement of sentence for the accused as against the judgment dated 09.11.2020. The accused also filed an Appeal against the conviction and the same was taken on file in Crl.A.No.912 of 2022 and hence, this Court directed the learned Additional Public Prosecutor to inform the counsel, who appears for the accused, about the filing of the present appeal. 2.Today, when the matter is taken up for hearing the learned counsel for the appellant/accused in Crl.A.No.912 of 2022 is present.

3. Heard both sides.

4. Though the reasons stated in the affidavit filed in support of this petition is not satisfied, as the appeal filed by the accused is taken on file,

in order to give an opportunity to appellant/State to proceed with the appeal, the delay is condoned.

5. The Registry is directed to take the appeal on file, if it is otherwise in order.
