Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to pass orders on the Petitioner's application dated 07.12.2009 granting patta in respect of the lands measuring 0.40 acre and 0.30 acres in Survey Nos.302/9 and 302/13 respectively in Kilkattalai village in Tambaram Taluk and Kancheepuram district within a time frame.

The prayer in the writ petition is for a Mandamus directing the respondents to pass orders on the Petitioner's application dated 07.12.2009 granting patta in respect of the land measuring 0.40 acre and 0.30 acres in Survey Nos.302/9 and 302/13 respectively in Kilkattalai village in Tambaram Taluk and Kancheepuram district.

3. The prayer itself in the writ petition is for a mandamus to direct the respondents to pass orders on the petitioner's application dated 07.12.2009 with regard to grant of patta. The granting of patta is not a matter of right and the same can be considered by the revenue authorities after having due enquiry of the petitioner as well as rival claims, if any.

4. In such view of the matter, this Court is of the view that a direction can be given to the second respondent to consider the representation of the petitioner dated 07.12.2009.

5. Accordingly, writ petition is disposed of directing the petitioner to send a copy of the representation dated 07.12.2009 to the second respondent within two weeks from the date of receipt of a copy of this order and on receipt of the representation, the second respondent shall consider the same of course, after having a due enquiry with regard to his claim for grant of patta in respect of the land measuring 0.40 acre and 0.30 acres in Survey Nos.302/9 and 302/13 respectively in Kilkattalai village in Tambaram Taluk and Kancheepuram district including the hearing of petitioner's claim as well as rival claims, if any and pass orders thereon within a period of three months thereafter. No costs.
