The petitioner, who was arrested and remanded to judicial custody on 30.12.2024 seeks bail in P.R.C.No.03 of 2024 for the offence punishable under Sections 147, 148, 294(b), 302 of IPC @ Sections 147, 148, 294(b), 120(B), 302 of IPC in connection with Crime No.625 of 2021, registered on the file of the respondent.

2. The learned counsel appearing for the petitioner submitted that the petitioner was arrested on the strength of the NBW through P.T Warrant and he is in prison from 30.12.2024. He further submitted that the petitioner is a sole breadwinner of his family and due to his incarceration, his family is suffering. He further submitted that the petitioner undertakes to co-operate with the trial.

3. The learned Government Advocate (Crl. Side) strongly opposed for grant of bail to the petitioner stating that the case is pending from the year 2021. He further submitted that, the NBW was issued in the year 2022 and the petitioner was secured on 30.12.2024. He also submitted that, apart from this case, petitioner to his credit has two previous cases. He further submitted that if the petitioner released on bail, there is a possibility that the trial could be stalled.

4. Considering the facts and circumstances of the case and the case is pending from the year 2021 without any progress, this Court is not inclined to grant bail to the petitioner at this stage.
