This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the securities in the name of Mr.N.V.Natarajan, father of the petitioner and the 2nd and 3rd respondent and the late husband of the 1st respondent. Mr.N.V.Natarajan died intestate on 03.12.1999. The details of the securities had been given in the schedule to the petition and they are share certificates in Tamilnad Mercantile Bank Limited. 2.Even though the petition has been filed after nearly 25 years from the date of death of Mr.N.V.Natarajan, since there are no other legal heir, the petitioner and the respondents are his Class-I legal heirs, I would take into consideration this petition.

3.After following due procedure, the petitioner was invited to tender evidence. Accordingly, he examined himself as PW-1. The death certificate and the legal heirship certificate of Mr.N.V.Natarajan were marked as Exs.P1 and P2. The documents relating to share certificates were marked as Exs.P3 and P4. smv 4.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the petitioner in accordance with the rules.
