By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to respondents 5 and 6 are dispensed with. 2.The present writ petition is filed praying for a writ of mandamus to direct the 2nd and 3rd respondent for change of name in manual as well as computerized Patta bearing No.1600, comprised in S.No.88/4, measuring an extent of 2 cents (828 sq.ft). Situated at Tammapatti Village, Gangavalli Taluk, Salem District and to dispose of the proceedings dated 23.06.2022 pending on the file of 3rd respondent, within a time frame to be fixed by this Court . 3.It is submitted by the learned counsel for petitioner that originally the above mentioned property was purchased by the 5th respondent herein from 6th respondent vide Sale Deed dated 06.07.2006, registered as 2/6
Document No.1351 of 2006 before the Sub Registrar, Thammapatti. After purchase, the 5th respondent, who is the petitioner's mother has been in continuous possession. It is submitted that on 03.01.2022, the 5th respondent executed a settlement deed in favour of petitioner, the same was registered as Document No.2 of 2022 before the Sub Registrar, Thammapatti.
4.It is submitted by the learned counsel for the petitioner that petitioner came to know that the patta stands in the name of 6th respondent for the above mentioned property. Thereafter, petitioner submitted a representation dated 13.06.2022 to the 2nd respondent for mutation of patta and also entries in computer records. The said representation was considered by 2nd respondent and forwarded to 3rd respondent vide proceedings dated 23.06.2022 to submit a report to the 2nd respondent. Thereafter, 3rd respondent directed 4th respondent to conduct a field enquiry. It is submitted that petitioner submitted another representation dated 08.07.2024 to the 1st respondent for change of name in manual as well as computerized patta and the same was taken on file on 09.07.2024 and the same is stated to be pending. Aggrieved by the same, the present writ petition has been filed. 5.At the outset, learned Additional Government Pleader for 3/6
respondents 1 to 4 would submit that they would consider the petitioner's representation and dispose of the proceedings dated 23.06.2022 in accordance with law, within a time frame to be fixed by this Court. 6.In view thereof, the writ petition is disposed of with a direction to the respondents 2 to 3 to consider the petitioner's representation and to dispose of the proceedings dated 23.06.2022, after affording reasonable opportunity of hearing to the petitioner, respondents 5 and 6 and any other interested parties/rival claimants, if any, within a period of 8 weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the same on its own merits and in accordance with law. There shall be no order as to costs.
