ORDER

The petitioners, who were arrested and remanded to judicial custody on 20.06.2025, for the offences punishable under Sections 126(2), 296(b), 115(2), 309(4), 311 and 351(3) of BNS, 2023 in connection with Crime No.268 of 2025, on the file of the respondent, seek bail. 2.The case of the prosecution is that the petitioners along with other accused waylaid the de-facto complainant and robbed Rs.1,500/- at knife point. Hence the case.

3.The contention of the learned counsel for petitioners is that the petitioners have been falsely implicated in this case as though they committed robbery and demanding Rs.1,500/- from the de-facto complainant. Since the petitioners have some previous cases, they have been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioners. 2/4

4.The learned Government Advocate strongly opposed the petitioners' contention submitting that both the petitioners are history sheeter. The offences are of serious in nature. The first petitioner is involved in offence under Sections 302 and 307 of IPC and having 9 previous cases. The second petitioner involved in offence under Section 307 of IPC and having 7 previous cases. Both have got criminal records and they were frequently engaging themselves in criminal activities and causing disturbance to the public and they are menace to the society. Hence, strongly opposed for granting bail to the petitioners.

5.Considering the fact that the petitioners are history sheeter and having previous cases, this Court is not inclined to entertain this petition and the same is dismissed.
