This petition has been filed seeking for return of passport which has been deposited before the Court below, pursuant to the conditions imposed by this Court in Crl.O.P.No.24899 of 2018, dated 26.10.2018.

2. The petitioner is a businessman who wants to visit various countries for business purpose. Therefore, he requires the passport for the purpose of getting visa to visit those countries.

3. Mr.A.Raghunathan, the learned senior counsel would submit that the petitioner is trying his best to settle the disputes. That apart, the petitioner has to make a visit to foreign countries for business purposes and the petitioner will return back to India within a period of three months. The learned senior counsel would further submit that the petitioner is a permanent resident in Chennai and all his relatives are in Chennai and the petitioner has already deposited a sum of Rs.25,00,000/- in the Court, pursuant to the directions given by this Court in the above said order. The learned senior counsel further submitted that the petitioner will return back to India within a period of three months. http://www.judis.nic.in

4. The learned Additional Public Prosecutor would submit that the petitioner should give an undertaking regarding the date on which he will return back to India after his business trip and sufficient conditions must be imposed before any permission is granted to the petitioner.

5. Taking into consideration the facts and circumstances of the case, the Court below is directed to return the passport to the petitioner subject to the condition that the petitioner undertakes to file an affidavit before the Court as to the date on which he is going to leave India and the date on which he will return back to India. The petitioner shall also provide particulars regarding the address for communication and the phone number in which he can be contacted, while he is staying abroad.
