This application has been filed by the applicant seeking permission to combine the causes of action in respect of infringement of trademark and passing off.

2. Considering the facts and circumstances of the case and considering the fact that the dispute is between the very same parties coupled with the further fact that the factual allegations are also same and in order to avoid multiplicity of proceedings, this application is ordered as prayed for.
