PRAYER:

Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 1st and 2nd respondents and its subordinates officers to cease interference in the petitioner society trade.

The grievance of the petitioner is that, the police attached to the 2nd respondent jurisdiction are interfering with the transport of sugarcane, since they are unregistered Cane Growers and Farmers Association at Pallipatu, the police may not be justified in restricting the transport. In this connection, the petitioner seems to have given representation to the 1st and 2nd respondent and since the representation was not considered, the present writ petition has been filed.

2.In my view, if the Superintendent of Police is called upon to consider the petitioner's representation, it would be appropriate, since this Court cannot step into the shoes of the respondent police for the purpose of addressing the petitioner's grievances and hence without going into the merits of the claim made by the petitioner in their representation, the 2nd respondent herein is called upon to consider the petitioner's representation dated 05.08.2019 as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.

3.This writ petition is disposed of, accordingly. Consequently, connected miscellaneous petition is closed. No Costs.
