Respondents Prayer: The writ petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus or any other appropriate writ or direction in the nature of writ directing the respondents to pay compound interest @ 12% p.a. for the belated payment of retirement benefits namely Gratuity, commutation of pension, Special Provident Fund, encashment of earned and unearned leave due to the petitioner within a reasonable time.

Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that relief sought for in this Writ Petition has become infructous for the reason that requirement of the petitioner for belated payment of retirement benefits namely Gratuity, commutation of pension, special Provident fund, encashment of earned and unearned leave due to the petitioner has been negatived in the order 08.06.2016, and it is also put to challenge in W.P.No.5902 of 2017 and the same is pending.

2.In the light of the said development, this writ petition is dismissed as infructuous, granting liberty to the petitioner to work out his remedy in the pending Writ Petition cited above. No costs.
