This petition has been filed to restore the above Civil Miscellaneous Appeal which was dismissed against the fifth respondent on 19.12.2023.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents 1 to 4. Though notice was served to the respondent No.5, there is no representation for the respondent No.5.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.

4. Accordingly this petition is allowed.
