ORDER
This application has been filed seeking appointment of a new body of Trustees for the Trust, Yadava Kalyana Mandapam Charities, Triplicane, Chennai in accordance with Clause 5(g) of the Scheme Decree in the suit, dated 02.05.1969.
2. In the affidavit filed by the Manager of the applicant Trust, it had been stated that a Scheme Decree had been framed by this Court with respect to Yadava Kalyana Mandapam Charity Trust. The Scheme Decree
provides seven Trustees to be appointed on rotational basis. It had been stated that the period of the Trustees had expired and therefore fresh Trustees would have to be appointed.
3. Applications were called for the eligible members to be appointed as Trustees. A list of nine members was forwarded. The Court had to appoint seven. The Court therefore called upon the nine members to conduct a meeting among themselves and directed the applicant to preside over the said meeting. It is observed that two applicants can withdraw with an assurance that they would be appointed as Trustees in the next term. Accordingly, a Memorandum had been filed on behalf of the applicant Trust.
4. I must deeply appreciate each and every member who had given their names to be considered as Trustees since they had come to an amicable settlement among themselves. Two of those who have given their applications had voluntarily withdrawn. This leaves seven members who could now perform the duties of the Trustees. A Memorandum had been filed by the learned counsel for the applicant which is as follows:

It is therefore most humbly prayed that this Hon'ble Court may be pleased to appoint the below mentioned 7 persons as Trustees to the Applicant Madam and thus render justice.

5. In view of the said Memorandum filed, the seven Trustees who had been named above are appointed as Trustees for the Yadava Kalyana Mandapam Charity Trust to discharge the duties in accordance with the Scheme Decree, dated 02.05.1969. It is hoped that they would act with
unity in furtherance of the noble objects of the Trust. They would be in term for a period of five years from this date. With the above observation, this application stands allowed. 01-07-2025 vum
