Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents 1 to 5 to remove the encroachment made by the 6th and 7th respondents in Plot No.88/28 of Kattukuppam Village, Manapet Revenue Village, Bahour Taluk, Puducherry.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.K.Sasindran, learned counsel for the petitioner and Mr.S.Raveekumar, learned Government Pleader (Puducherry) for respondents 1 to 5.

2. Learned counsel for the petitioner submits that Plot No.88/28 is a Government poramboke land and respondents 6 and 7 have encroached upon the said plot.

3. Learned Government Pleader (Puducherry) submits that the

petitioner has filed a civil suit against respondents 6 and 7 and also Government authorities. Respondents 6 and 7 have also applied for patta in respect of the said plot. However, the said application is not processed in view of the civil suit filed by the petitioner.

4. As the civil dispute between the parties is pending, no further orders are passed in the present writ petition. The parties may take steps in accordance with law and as permissible under law.

5. With these observations, the writ petition stands disposed of. There will be no order as to costs.
