This Criminal Original Petition has been filed seeking to enlarge the petitioner on bail in Crime No.234 of 2022 on the file of the respondent Police.
2. The case of the prosecution is that on 16.08.2022, the petitioner along with the other accused trespassed into the office of the de-facto complainant and by threatening him at knife point, robbed an amount of Rs.6,93,745 from him. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and since, he happens to be the friend of the other accused, he has been falsely implicated in this case. He would also submit that the petitioner has been in custody from 16.08.2022. Hence, he prays for grant of bail to the petitioner.
4. Per contra, the learned Government Advocate (Crl.Side) would submit that the petitioner along with the other accused, armed with weapons trespassed into the office of the de-facto complainant and robbed an amount of Rs.6,93,745 from him at knife point. He would further submit that Rs.4,00,000/-has been recovered from this petitioner alone and the remaining has to be recovered. He would also submit that the investigation is pending. Hence, he vehemently opposed for grant of bail to the petitioner.
5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the materials available on record.
6. Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side), this Court is not inclined to grant bail to the petitioner for the present.
7. Accordingly, this Criminal Original Petition stands dismissed for the present.
