The Criminal Miscellaneous Petition is filed seeking to extend the time for surrender as per clause (iii) and for payment of fine amount as per clause (iv) of order passed in Crl.M.P.No.7233 of 2024 in Crl.A.No.488 of 2024 dated 11.06.2024.

2.The petitioner was granted bail by this Court on 11.06.2024 imposing certain conditions. Condition No.(iv) is that the petitioner to pay the fine amount of Rs.1,00,000/- within a period of one month from the date of receipt of a copy of that order.

3.The contention of the learned counsel for petitioner is that the petitioner executed sureties and came out on bail on 17.07.2024 and he is unable to mobilise the fine amount of Rs.1,00,000/- till date. He has already sought assistance from several persons and he is confident that Rs.1,00,000/- will be made ready by him by 01.09.2024 and on 02.09.2024, he will appear before the trial Court and deposit Rs.1,00,000/- to the credit of C.C.No.7 of Page 1/3

2019 on the file of I Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai.

4.The learned Government Advocate (Crl. Side) opposes the same stating that one month period already elapsed. The petitioner is now enjoying the freedom and evading payment of fine amount. 5.It is seen that the petitioner is only a Driver and he was in incarceration for more than five years from the date of his arrest. That was one of the reason for granting bail. In view of the same, the petitioner's request can be considered.

6. Hence, this Criminal Miscellaneous Petition is ordered and the petitioner is granted time as prayed for by him. 14.08.2024 rsi Page 2/3
