The petitioner herein is an accused on a complaint given by his wife and pending investigation as C.S.R.No.247 of 2024. The petitioner is before this Court seeking protection from police harassment. 1/4

According to the learned counsel for the petitioner, two minor children of the petitioner are under his custody. The daughter of the petitioner studying 7th standard at Hooghly, West Bengal. However, based on the complaint given by his wife, the respondent police threatening him to handover the custody of the children to his wife. 3.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that C.S.R., is being enquired, if any commission of offence is made out, police will proceed in accordance with law and gives an undertaking that the custody of the children will not be disturbed prejudicial to their education. 4.

In view of the above submission, this Criminal Original Petition is disposed of.
