By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed for a writ of certiorarified mandamus, challenging the proceedings dated 08.05.2024 of the 8th respondent wherein there is a recommendation to reclassify the Adi Dravida Natham Land comprised in S.No.262/1, No.31, Vallipuram Village, Thirukalukundram Firka and Taluk, Chengalpattu District admeasuring 0.55.0 Ares (1.3 Acres) into Government Porambokku/Drainage land.

According to the petitioner, the petitioner and 21 other families are residing in Adi Dravida Natham Land comprised in Old S.No.262/1, New S.No.364/1, Vallipuram Village, Thirukalukundram Firka and Taluk, Chengalpattu District and pattas have also been issued to the occupants. While so, the grievance of the petitioner is that the 8th respondent has submitted a report to the 3rd respondent, recommending reclassification of the subject land as Government Natham Poramboke/Drainage Land in the computerized A-Register and thereby depriving the rights of the schedule caste community people vide impugned communication dated 08.05.2024. Hence, this writ petition. 3/7

At the outset, it is submitted by the learned Special Government Pleader for the respondents that this writ petition is premature inasmuch as the impugned communication is only a recommendation and the said recommendation would have to be considered by the 3rd respondent in concurrence with the Commissioner of Land Administration, who would be the appropriate authority to reclassify the land. He further submitted that before reclassifying the land, the 3rd respondent would afford the petitioner an opportunity of being heard, which was agreed to by the learned counsel for the petitioner.

In view thereof, this writ petition stands disposed of with a direction to the 3rd respondent, to examine the impugned recommendation submitted by the 8th respondent dated 08.05.2024 for re-classification of the subject land in accordance with law and before resorting to any such re-classification, afford an opportunity of hearing to the petitioner and other stake holders of the subject land and consider their objections if any being made by them. It is made clear that this Court has not expressed any views with regard to the merits of the matter and it is open to the 3rd respondent to consider the matter on its own merits and in accordance with law. No costs. Connected miscellaneous petitions are closed. 4/7
