ORDER
This writ petition has been filed to call for the records of the first respondent relating to G.O. (1D) No.71, School Education (A2) Department, dated 01.03.2010 to quash the same and to direct the respondents to disburse all the retirement and pensionary benefits with interest on delayed payment.
2. Learned counsel appearing for the petitioner would submit that for the allegations of the year 2000-2001, the impugned order dated 01.03.2010 was issued by the 1st respondent, thereby ordered an amount of Rs.500/- p.m. to be recovered from the petitioner's pension amount for a period of five years. He further submitted that after conducting an enquiry, charge memo was issued to the petitioner in the year 2005, whereas the impugned order was passed in the year 2010, which is beyond the period of four years, that too when the petitioner retired from service in the year 2003. Hence, he prays for quashment of the impugned order.
3. Learned Government Advocate appearing for the respondents on 2/4
instructions would submit that though punishment was imposed on the petitioner, the respondents have not made any deduction from the petitioner's pension and in view of the above, the writ petition may be closed.
4. Recording the fair submissions of the learned Government Advocate appearing for the respondents, this writ petition is closed. It is made clear that closure of this writ petition will not entail, recovery of any amount from the petitioner. No costs. Consequently, connected miscellaneous petition is closed.
