A.No.4341 of 2022 is filed to grant leave to the applicant to produce photo copies of the schedule mentioned documents filed along with affidavit as secondary evidence.
2.The learned counsel for the applicant submitted that the documents sought to be marked are either documents from the plaintiff or from Canara Bank, except documents 1 to 3. Applicant is not in possession of originals for the reason that he received only xerox copies of the documents. So far as Serial No.1 to 3 of the documents, he misplaced the originals and therefore photo copies are produced.
3.The learned counsel for the respondent/plaintiff has no objection for allowing this application.
4.Considering the reasons stated in the application and being satisfied with the reasons, this application is allowed. 5.Matter is sent back to the learned Additional Master for continuation of recording of evidence.
6.Post the matter after two weeks.
