ORDER

The petitioner lodged a private complaint before the Additional Mahila Court, Salem under Section 156(iii) of Cr.P.C and the same was taken on file in Crl.M.P.No.1106 of 2024. Though the petition filed on 18.04.2024, till date, no orders passed.

2. The learned counsel appearing for the petitioner submitted that it is the case for the offence under Sections 294(b), 324, 498(A), 506(ii) of IPC. The Apex Court had held that in a case of Section 498A of IPC, the place of residence of the complainant is sufficient to initiate the complaint. What is the reason for keeping the case pending without any progress not known.

3. On considering the submissions made by the learned counsel appearing for the petitioner and on perusal of the records, it is seen that initially, the complaint filed before the Magistrate Court on 0104.2024 and the same was returned on the point of jurisdiction. Thereafter, the petitioner presented the complaint before the Additional Mahila Court, Salem on 18.04.2024 under Section 156(3) of Cr.P.C. and the same 2/4

taken on file in Crl.M.P.No. 1106 of 2024, but it is kept pending without any progress.

4. In view of the above, the Additional Mahila Court, Salem, is directed to consider the petitioner's complaint in Crl.M.P.No.1106 of 2024 and pass appropriate orders on its own merits and in accordance with law, within a period of 30 days from the date of receipt of a copy of this order.
