This application has been filed by the applicant/plaintiff to grant leave to him to file the documents as mentioned in the Judges Summons on his side.

2. The learned counsel for the respondents/defendants submitted that the applicant has failed to provide a sufficient explanation and reason for the gross delay of 11 years in placing the death certificate and this application has been filed belatedly after 11 years, only to drag the proceedings and hence, he strongly opposes to allow this application.

3. Considering the facts and circumstances of the case and having satisfied with the reasons stated in the affidavit filed in support of the application, this Court is inclined to permit the applicant/plaintiff to mark the document as listed in the Judges summons, however, subject to admissibility, relevancy and proof. Accordingly, this application is allowed.

4. Registry is directed to post the matter before the Master Court for recording evidence on 21.09.2023.
