2. The learned counsel for the second respondent has serious objection in allowing this petition.

3. The petitioner would aver that, on account of the injuries sustained over his leg, due to the accident he could not continue to work as a driver. He would further aver that he has already incurred huge debts and is not in a position to mobilise funds to meet the medical expenses. Hence, a delay of 296 days occurred in preferring this Civil Miscellaneous Appeal.

4. Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 296 days shall stand waived.
