Respondents Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the third respondent to remove the encroachment made by the seventh respondent in Survey Nos.38/1b and 44/1 at Esayanur Village, Arcot Taluk, Ranipet District and subsequently cancel the patta in Survey Nos.38 and 44 at Esayanur Village, Arcot Taluk, Ranipet District.

ORDER
(Order of the Court was made by M. SUNDAR, J.) After some arguments, Mr.R.Sunil Kumar, learned counsel for writ petitioner sought leave of this Court to withdraw the captioned writ petition but made a plea to preserve all the rights and contentions of the writ petitioner to seek cancellation of patta under 'the Tamil Nadu Patta Passbook Act, 1983 (Tamil Nadu Act 4 of 1986)' [hereinafter 'said Act' for the sake of brevity and convenience].
2. If the writ petitioner resorts to such a procedure, we make it clear that any person put on notice will have all the rights and contentions preserved untrammeled by this order.

4. In the light of the narrative thus far, captioned writ petition is disposed of as withdrawn/closed albeit with preservation of rights and contentions of the parties in the aforesaid manner. There shall be no order as to costs.
