ORDER
The petitioner, who was arrested and remanded to judicial custody on 02.06.2026 for the alleged offences under Sections 420, 465, 467, 468, 471 and 472 of I.P.C., in Crime No.33 of 2024 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the accused persons created forged documents including death certificates, legal heir ship certificates and other
connected records. It is alleged that they used these forged documents to execute a sale deed dated 21.01.2023. Hence the case. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 02.06.2026. He further submitted that the occurrence took place on 21.01.2023 whereas the First Information Report was registered only on 10.06.2024. He contended that the petitioner is no way concerned with the fabrication of the documents and has been falsely implicated in this case. He has also pointed out that the co-accused has already been released on bail by the trial Court. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the modus operandi of the petitioner, along with A1 and A2 was to register the sale deed with fraudulent intent of acquiring the property after the owner's demise. Hence, he opposed for grant of bail to the petitioner. 5.Although there are allegations against the petitioner, it is a fact that the co-accused has already been granted bail by the trial Court. Furthermore, the occurrence took place on 21.01.2023, the First Information Report was registered only on 10.06.2024. Under such circumstances and considering the long incarceration of the petitioner since 02.06.2026, this court is of the firm
view that his further custody for the purpose of investigation is not necessary. Consequently, this Court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate Court No.II, Chengalpattu, and subject to the following conditions:
[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the respondent police daily at 10.30 a.m until further orders; [c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions had been imposed and the petitioner released on bail by the learned Magistrate/Trial Court itself, as laid down
by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[f] if the petitioner thereafter abscond, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023.
