PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus directing the 4th respondent to pass orders on the representation dated 29.06.2024 revoking the suspension order in Ref.No.A6/74/2024 dated 12.01.2024 within a period to be stipulated by this Court.

This writ petition has been filed for the issue of writ of Mandamus directing the 4th respondent to consider the representation made by the petitioner on 29.06.2024 wherein the petitioner has sought for revocation of the suspension order dated 12.01.2024 and for reinstatement of the petitioner into service.

Heard Mrs.S.Kanimozhi Sundar, learned counsel for the petitioner and Mr.G.Velu, learned Additional Government Pleader for Respondents 1 to 5.

The case of the petitioner is that he was working as a Village Administrative Officer at Mathalapattu Village, Cuddalore District. On 11.01.2024, a trap was laid and the petitioner was arrested and remanded to judicial custody in the course of investigation in Crime No.1 of 2024. Based on the same, the petitioner was placed under suspension through proceedings dated 12.01.2024.

The grievance of the petitioner is that he was placed under continued suspension and therefore, he made a representation dated 29.06.2024 to the 4th respondent requesting for cancelling the suspension order. Since the same did not evoke any response, the present writ petition has been filed before this Court seeking for appropriate directions. 5.

Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the 4th respondent to consider the representation made by the petitioner on 29.06.2024 and deal with the same on its own merits and in accordance with law and take a decision within a period of six weeks from the date of receipt of the copy of this order. 3/5

The petitioner is directed to make a fresh representation to the 4th respondent along with a copy of this order. 7.

This writ petition is disposed of with the above directions. No costs.
