Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 2nd respondent to pay the balance sum of Rs.32,78,117/- to the petitioner for the completion of the work order bearing ROC.No.3531/2018/E1 dated 27.02.2019 along with interest @ 12% per annum from date of completion of work till date of realisation, within a time frame to be fixed by this Court.

The petitioner herein seeks a direction to the 2nd respondent to pay the balance sum of Rs.32,78,117/- (Rupees Thirty Two Lakhs Seventy Eight Thousand One Hundred and Seventeen) towards the work executed by him as per the Work Order bearing R.O.C.No. 3531/2018/E1, dated 27.02.2019, with 12% interest per annum from the date of completion of the work till the date of realisation.

2.When the writ petition is taken up for hearing, the learned Special Government Pleader appearing for the respondents submitted a written instruction of the 2nd respondent. In the written instruction, it is mentioned by the 2nd respondent that the Municipality is financially very weak and they will pay the balance amount to the petitioner within a period of three (3) months in installment basis.

3.In view of the stand taken by the 2nd respondent Municipality, this Court is inclined to issue a direction to the 2nd respondent Municipality to pay the balance sum of Rs.32,78,117/- in three equal installments within a period of twelve weeks from the date of receipt of copy of this order. The 1st installment shall be paid by the 2nd respondent before the expiry of four weeks and the 2nd installment shall be paid within a period of eight weeks and the last installment shall be paid within a period of twelve weeks from the date of receipt of copy of this order.
