This Court by order dated 07.11.2023, had appointed Hon'ble Mr.Justice N.Authinathan (Retd.,) Former Judge of this Court, as an arbitrator to resolve the inter se dispute between the parties. Now, the Arbitrator, by his letter dated 26.12.2023, has recused himself from hearing the case.

2. The learned counsel for the petitioner would submit that a new Arbitrator be appointed.

3. In view of the above, this Court is inclined to appoint Hon'ble Mr.Justice.K.N.Basha (Retd.,), Former Judge of Madras High Court residing at DR.Ambedkar Road, (Old ICF Link Road), North Thirumalai Nagar, Villivakkam, Chennai, (Mobile No.9444454545) as an new Arbitrator to enter upon reference and adjudicate/resolve the inter se dispute between the parties.
