O R D E R
The name of the petitioner was sponsored by the Employment Exchange to the respondent Board for appointment to the post of Graduate Assistant. The first respondent, in turn, issued a call letter dated 02.2.2011 directing the petitioner to produce certificates.
2. It is the case of the petitioner that she produced all the certificates, but, however, there was no follow up action taken by the respondent to appoint her.
3. The petitioner earlier filed a writ petition in WP.No.26106 of 2011 for a direction to the respondent to appoint her. The said writ petition was dismissed as withdrawn with liberty to file a fresh writ petition with better particulars.
4. The learned counsel for the petitioner submitted that the respondent has not finalised the selection and still there are vacancies earmarked for Scheduled Caste. The learned counsel by producing the information obtained by the petitioner under Right to Information Act submitted that several vacancies under Scheduled Caste quota are available for appointment. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Additional Government Pleader, on instruction, submitted that the petitioner has produced the certificates only after 2 1⁄2 months and that was the reason for not considering her name for the post of Graduate Assistant
5. The petitioner is given liberty to submit a comprehensive representation to the respondent indicating the reasons including the factors which attributed for the delay in producing the certificates. In case, there are vacancies still available, such representation shall be considered leniently by the respondent. Such exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
6. The writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
