PRAYER: This Criminal Original Petition has been filed under Section 482 of Cr.P.C to call for records in Cr.No.83 of 2021 on the file of Gengavalli Police Station, Salem District to quash the same.

ORDER

The petitioner and one Mr.Sownthiram are the accused in Crime No.83 of 2021, for the offences under Sections 341, 294 (b), 323, 506(i) of IPC. The petitioner has filed this Criminal Original Petition to quash the proceedings against him in Crime No.83 of 2021 on the file of the Gengavalli Police Station, Salem District.

2. The learned Counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and without any basis, the first respondent police has registered a case in Crime No.83 of 2021 for the aforesaid offences as against the petitioner and another accused. Hence he prayed to quash the same.

in this case, the investigation was completed and the charge sheet has been filed before the learned Judicial Magistrate II, Attur, against the petitioner and another accused and the same was taken on file as C.C.No.231 of 2021 on 15.04.2021. Now the case is posted for the appearance of the accused.

4. Heard Mr.M.Aswin, learned counsel appearing for the petitioner and Mr.E.Raj Thilak, learned Additional Public Prosecutor appearing for the first respondent.

5. In view of the submissions made by the learned Additional Public Prosecutor that the investigation was completed and charge sheet has been filed before the Court below, this Court is of the view that no orders requires to be passed in this petition.
