The petitioner, who apprehends arrest at the hands of the respondent Police for the alleged offences punishable under Section 25(1B)(a) of Arms Act, 1959 in Crime No.255 of 2023, seeks anticipatory bail.
2. The case of the prosecution on 30.06.2023, at 01.30 a.m., the Inspector of Police along with her team on the patrol duty and they heard a noise on Naikkenpatty Road, near the thornbush. They went there and found a country gun along with a two wheeler without a number plate. During the course of investigation, it came to light that the petitioner along with other accused were involved in the commission of the offence. Hence the case.
3.Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and based on the confession statement of A1, he has been falsely implicated in this case as A3. He would further submit that similarly placed co-accused namely A1 and A2 were earlier arrested and later, enlarged on bail. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate appearing for the respondent Police submitted that the petitioner along with other accused were involved in the commission of the offence. 5.Heard the learned counsel for the petitioner as well as the learned Government Advocate and perused the entire materials available on record.
6.This Court taking into consideration the facts and circumstances of the case and also the submissions made by the learned counsel on either side and also considering the gravity of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
