ORDER

This Criminal Original Petition has been filed by the petitioner to direct the respondents 1 and 2 to give police protection to the petitioner and his family members.

2. The case of the petitioner is that the private respondents under the guise of Panchayat, trying to lay road forcibly in his Patta land. They also trespassed in to his land and caused damages to his paddy field and also destroyed his water channel meant for irrigation and loaded stones in a manner obstructing the water flow to his field. When the same was questioned by the petitioner, they scolded him with filthy language and also assaulted and threatened to kill him. Though the petitioner lodged a complainant with the respondents police on 21.08.2024, so far no enquiry has been conducted and no 2/5

FIR has been registered. The third respondent is a President of the Panchayat and her husband was a District Public Prosecutor of Krishnagiri PDJ Court and that the private respondents are politically influential in the locality. Further, the village people, on the instigation of the third respondent, not allowing the petitioner and his wife into the village to worship the village Amman temple. During night times, the villagers throwing stones indiscriminately on the house of the petitioner. Hence, with no other option, the present petition is filed.

3. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that so far no such complaint has been received by the respondents police.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) and perused the materials available on record.

5. Since no adverse order is being passed against the private respondents, notice to the private respondents is dispensed with. 3/5

6. Considering the facts and circumstances of the case, the petitioner is directed to give a fresh complaint/representation to the respondent police and on receipt of the same, the respondent police is directed to conduct enquiry and proceed in accordance with law.

7. With the above directions, this Criminal Original Petition is disposed of.
