Prayer :- Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to consider and pass orders on the appeal petition of the petitioner dated 28.06.2011 which was submitted against the order of punishment of stoppage of increment for 3 years without cummulative effect imposed by the 2nd respondent in Na.Ka.No.4420/2011/F1 dated 11.06.2011. With the consent of either side, the Writ Petition itself is taken up for final disposal at the admission stage.

2. The petitioner seeks for issuance of Writ of Mandamus directing the 1st respondent to consider and pass orders on the appeal petition of the petitioner dated 28.06.2011, which was submitted against the order of punishment of stoppage of increment for 3 years without cummulative effect imposed by the 2nd respondent in Na.Ka.No.4420/2011/F1 dated 11.06.2011.

3. The case of the petitioner is that the petitioner has preferred an appeal way back in the year 2011 before the 1st respondent against the order passed by the 2nd respondent in Na.Ka.No.4420/2011/F1 dated 11.06.2011, wherein the petitioner was imposed with a punishment of stoppage of increment for 3 years without cumulative effect.

4. Since the said appeal has not been considered and the petitioner is due to retire during December 2016, the petitioner has come forward with this Writ Petition. 5.

Heard Mr.P.Chinnadurai, learned Government Advocate for the respondents.

6. In the light of the above, without going into the merits of the petitioner's appeal, there will be a direction to the 1st respondent to hear and dispose of the appeal filed by the petitioner within period of two months from the date of receipt of a copy of this order.

7. In the result, the Writ petition is disposed of. No costs.
