J U D G M E N T
(Delivered by Dr. A.D. Maria Clete, J) This Civil Miscellaneous Appeal has been filed by the appellant to enhance the award passed by the Motor Accident Claims Tribunal in M.A.C.T.O.P.No.2212 of 2018 on the file of the Motor Accident Claims Tribunal, Cuddalore, Special Sub Court, Cuddalore.
2. Today, when the matter is taken up for hearing, the learned counsel appearing for the appellant as well as the learned counsel appearing for the respondent / Insurance Company submitted that the parties have arrived at a settlement for a sum of Rs.33,00,000/- in full quit in favour of the appellant and filed a memo of compromise signed by both the respresentative of the appellant as 2/5
well as the respondent and also by the learned counsel appearing for the appellant and the learned counsel appearing for the respondent.
3. Recording the memo of compromise, this Civil Miscellaneous Appeal is disposed of as settled out of Court. The respondent / Insurance Company is directed to deposit the sum of Rs.33,00,000/- less the amount already deposited, if any, within a period of four weeks from the date of receipt of a copy of this judgment. On such deposit, the appellant is permitted to withdraw the award amount, less the amount if any, already withdrawn. The memo of compromise shall form part of the decree and Judgment. No costs.
