PRAYER: Original Petition filed for Succession Certificate under Sections 372 of Indian Succession Act read with Order XXV Rule 6 of O.S.Rules, praying that a Succession Certificate may be granted to the 1st petitioner with power to collect the debts and to receive the interest specified in the schedule hereto.

ORDER

The petitioners seek Succession Certificate in favour of the first petitioner in respect of the securities held by Late Geetha Ramakrishnan, who died intestate on 10.05.2022 at America. The petitioners are the husband and minor son of the deceased. The first petitioner represents the second petitioner since he is the father and natural guardian of the second petitioner.

2. The first petitioner has been examined as PW1. He has produced the death certificate of the deceased as Ex.P1. The legal heir certificate of the 1/4

deceased as Ex.P2. On perusal of Ex.P2, it shows that the petitioners are the husband and the minor child of the deceased and only surviving legal heirs of the deceased.

3. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioners are entitled to the relief.

4. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the first petitioner, with the power to collect the securities and receive the interest and dividends mentioned in the schedule to the petition.
