ORDER

This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 961 days in filing the above Criminal Revision Case against the order dated 07.09.2022 passed in Crl. M.P.No.997 of 2021, on the file of District Munsif cum Judicial Magistrate at Sendhurai, Ariyalur Dt. 2/6

2. Mr.G.Anantharangan, learned counsel for petitioner submitted that due to his health condition and also due to his old age ailments, the petitioner is not able to follow up case proceedings and he is not able to prefer the above Criminal Revision case within a stipulated time and only during month of June 2025, he gave papers to him, as a result of which, there is a delay of 961 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Dr.C.E.Pratap, learned Government Advocate (Crl. Side) for 1 st respondent appeared and raised objections stating that there is an inordinate delay, but the reasons for the delay was not properly explained.

4. Considering the facts and circumstances, and considering both side submissions and the fact that the reasons stated by the petitioner in the affidavit seems to be justifiable one and to give one more opportunity, this court is inclined to allow this petition on condition that the petitioner shall pay a cost of Rs.2000/- payable to the learned Government Advocate (Crl. Side) appearing for 1 st respondent within one week from the date of receipt of copy of this order. On such payment, Registry is directed to number the Criminal Revision Case if it is otherwise found to be in order and post the matter on 08.10.2025. 23-09-2025 3/6
