ORDER

This application has been filed under Section 29A of the Arbitration and Conciliation Act, 1996 [hereinafter referred to as 'the Act'] for extension of the mandate of the sole arbitrator for a further period of six months.

2. This Court permitted the learned counsel for the applicant to serve notice on the learned counsel, who appears for the respondent 1/4

before the Arbitrator. Accordingly, notice was taken and affidavit of service was also filed. Notice has been served on the learned counsel for respondent. There is no appearance either in person or through counsel.

3. This Court carefully considered the submissions made by learned counsel for applicant and the materials available on record. The period mutually extended by the parties for six months came to an end on 23.03.2025. Since the proceedings were not completed even after the extended period, the present application has been filed before this Court seeking for further extension of six months. Learned counsel for applicant submitted that proceedings are now at the stage of cross-examination of witnesses.

4. Taking into consideration the facts and circumstances of the case and considering the reasons assigned and this Court, having satisfied that there is sufficient cause and in order to facilitate effective dispute resolution and not to close the proceedings on technicalities and on placing reliance upon the judgment of the Apex Court in Ajay Protech Pvt. Ltd. vs. General Manager and Another [2024 SCC Online SC 3381], this Court is inclined to extend the mandate of the sole arbitrator 2/4

up to 03.11.2025.
